I need Help with a citation


Pennsylvania

I have was in a car accident on December 24, 03
The accident happened while i was changing from the left lane to the right lane after i have passed a car. As i was turning into the right lane my car hydro-planed and spun out and hit the embankment on the right shoulder. I was the only one involved in this accident so no damage was done to any other automobile. After the State police were called i gave the officer all of my information and he gave me a receipt for the accident report. Now almost a month later i have recieved a traffic citation for "Disregarding Traffic Lane (single)". At the time of the accident I was not given a citation nor was i informed that i would be recieving one, should the officer have given me the citation at the time of the accident. Can i fight this and how?

Note: I did not sign any citation, and i stated to the officer that i was not speeding and their were no witnesses.

It sounds as if the trooper did an investigation and determined you were at fault for the accident and violated the law. It was most likely determined that someone observed you not use your turn signal when you made the lane change.

How much over the speed limit were you going when this happened?

In the statement i gave the state trooper i said i was going 65-70

I don't know how he could have done an investigation there was no one that he could have talked to besides me, a woman pulled over and called the police but she left before the state trooper got there. I also find it odd what the officer wrote on the citation.

"Defendent failed to drive the vehicle within a single lane resulting in a crash"

I was done passing and turning into the right hand lane when it happened, id really like to know how that can be illegal.

On the charge part of the citation is written:

"Driving on roadways laned for traffic"

What does that mean?!

Question, don't i have to sign the citation at the time it was issued, he didn't even say that i would be getting one

BTW this roadway was the Pennslyvania turnpike which is 65 mph speedlimit

State Troopers give a 10 mph cushion

Either pay the ticket or show up in court and plead not guilty. If the officer is there the court will find you guilty and probably add court costs to the fine.

Similar thing happened to me here in WA state.

I hit black ice doing approx. 35 mph on the on-ramp of the freeway.
I hit the cement railing - damaged my company vehicle bumper. I called my boss who told me to call the state patrol. Patrolman came, took my statement, told me he would send my employer a collision report.


Three weeks later I get a huge speeding ticket. The date on the citation was one week after the accident. I'm contesting it, we'll see what happens.
