| I got pulled over for allegedly doing 82 in a 65, when I know I didnt break 75! I admit I was speeding a little but the reason was there was quite a bit of traffic (couldnt get over) and a guy was riding my tail going just as fast or faster than I was. When I got pulled over I watched in my rearview mirror as the cop actually had to WAIT for the guy to get off my tail before he got behind me and flashed his lights (i was still the one pulled over). I tried to explain to the officer that the guy behind me was riding too close (which I thought itself was against the law.. maybe not? Im in TEXAS) and his headlights were blinding me but he still gave me a ticket and said I should have hit my brakes and got over. Is there a chance in hell I could fight this and win? I know it will probably end up being my word against his BUT my sister was in the car with me and witnessed the entire thing. Anyone have an experience like this? What should I do? Thanks |

| It is your lucky day kid. At least you have better luck here than driving. You get a ticket for speeding and you get into an accident with no insurance. And you are also a liar because the entire incident of your alleged speeding had to have happened for a duration of more than 5 seconds. You had better learn the law kid. You state that you didn't break 75. Which means that you allege you were going between 70-74 mph. Hey wake and smell the jail bars. If the speed limit was 65 mph, even if you were going 66 mph, you would be legally speeding. You even admit you were speeding. If I were the judge, I would not believe your story even for one second. Too wishy-washy. [Edited by HomeGuru on 02-18-2001 at 03:52 AM] |

hmmfirst off, im not a liar. it happened in little more than 5 seconds, if 5 seconds at all. the cop was in the emergency (not moving) lane and i was in the left lane with some guy on my ass, and i happened to speed up AND slow back down BEFORE i even reached the cop. Now I dont know about the POS you drive.. But my car is capable of accelerating more than 5mph per 5 seconds. If I had a car that weak I wouldnt be on the freeway in the first place (can we say go-cart?) I admit to doing about 70 beforehand, which was only 5mph over and is very common.. So why the hell should I pay for 82 in a 65 when I wasnt doing more than 75, during the period that I actually sped up and he claims to have clocked me? Because of the traffic, he could have actually clocked any number of people beside or behind me, and I just happened to be the front man and took the fall. I dont know about you but in tx it costs something like $15 -$20 per mph over the speed limit. That makes a difference of more than $100 bucks when I wasnt even going that fast. that in addition to the bullcrap court costs/fine I would have to pay. I guess what I was asking was if there was a chance there are still HUMAN judges out there, who would possibly realize that my INTENT was not to speed, but was to actually avoid a possible accident, because some shmuck wanted to ride my ass on the freeway. You, however, do help me realize that most people out there are still jerks, and there is no chance of understanding. By the way, next time you do more than a mph over the speed limit, be sure to eat your words because at that point you will have become a **** talking, cynical hypocrit who for some reason exhibits a state of self-righteousness in your messages. Your day will come... Best wishes, Mark |

| Judge: Mr. Mark, I see you have a speeding ticket which you are contesting. Mr. Prosecuting Attorney, does he have any previous moving and/or other violations on his record? Has his drivers license ever been suspended? Mr. Mark, do you have a clean criminal record? Have you been to Court before? Have you gotten into any accidents? Have you ever been driving without insurance? Have you ever left the scene of an accident and not called the police. Was it because you had no insurance and proper vehicle registration? What? You have? And you admit that you were going at least 70 mph.? Now tell me Mr. Mark, with a record such as yours, why should I believe you rather than the police officer that clocked you going 82 mph.? Are you telling me that the police officer is lying? Mr. Mark, you are only 19 years old. I wasn't born yesterday. I have heard the same story and excuses many times over. Do you wish to change your plea?
