improper lane change - agressive driving?

This is more to settle a discussion so comments are appreciated.

3 Lanes of traffic are merging to 2 lanes due to road construction. The left lane is closed and is marked for several miles in advanced. A car continues to proceed past cars waiting in the right two lanes and attempts to pull into the middle lane but sticking the nose of his car into the lane. The driver in the middle lane continues forward, not expecting the car to pull right without clearance. Cars collide - both are claiming they were in the right. Middle driver claiming improper lane change and aggressive driving and the left lane driver claiming that he had a turn signal on and the middle driver did not make an attempt to avoid an accident?
