Improper/No SignalWhat is the name of your state? New York I was hoping someone can help me out with this one. I am new to this and I feel so lost. I am a Toronto Driver going home from NYC one night. I was driving within the speed limit of 65mph on Hwy 90. As I was driving through across over bridge, I saw a parked police car hidding under the bridge facing the direction I was driving to. At the time I was driving on the fast lane trying to past a few cars and there was a speeding car about 10 meters in front of me. As I drove past the police car, I did check my speed and it was close enough to 65mph. 10 seconds later, I check my rear mirror and I saw an extremely fast car approaching very quickly behind me. It must have been at lease 15-20 meters away when I checked the mirror. Therefore, my first reaction was "move out of the way". Hence, I slowly move to the right lane then signal. (Please note, there was no car behind me on the right lane and there is a car 5 meters ahead of me on the right lane.) Then I saw a car suddenly appear on the right side and it was the car that was approaching very quickly. Later I realized that was the police car from under the bridge. Then he turned on the overhead lights to stop me. The first thing that came out from the officer/trooper was did you know you almost cause an accident. Then he example, he was going to catch the car in fornt of me for speeding. But now charge me for improper/no signal instead of catching that car. In Canada when a police car wants to go ahead of you, they will give you some sort of signal (ie overhead lights / flashing head lights, Siren...etc). All use the fast lane/ LEFT lane for overtake and not the right lane. This officer/trooper, did not make any signal what so ever. Trying to overtake me by using the right lane catching a speeding driver. And now charge me for no signal... If he was chasing a drug dealer or something, I would understand why he was drive so fast. He must have been driving at least 120 mph. It happened at the two lane part of Hwy 90, and there is a shoulder lane on the LEFT side which he could have been easily drive through that way OR even better just flash has headlights requesting to move out of the way. But no, he decided it will be easier for him to cut through by using the right lane. Now my question to all of you out there is should I plea "guilty" or not. If I plea guilty how much would the ticket be? If I plea not guilty, what is my chances? Thank you for all of you taking the time to read this long story. Hope you can help me. |

| Let's boil this down a bit. You were charged with failing to properly signal. You acknowledge that you didn't properly signal. Your actual question is "How much is the fine", since you acknowledge that you are guilty, correct?

| Lets put it this way, everything happened in a split second. It is a natural response to move out of something coming very fast behind you. Yes, I started slowly moving towards the right side of the fast lane. However, BEFORE my car cut across the lane, the signal was ON already. Honestly, I don't feel that I failed to signal under this situation. I thought the car was going to hit me from behind. Besides, no one would have thought someone will over take you on your RIGHT side when there is a car 5 meters in front on the right lane. I guess you feel that I am guilty. If I plea guilty, how much is the fine? |
