Improper TurnWhat is the name of your state? OHIO This is about a ticket my 24 yr old son received for an improper turn. The ONLY reason I wish to fight this case is it will be the STRAW that will cost our family an Insurance cancellation. Due to a few minor tickets and 3 insurance claims 1 glass breakage and one comp claim. The facts My son was in a left turn lane at a red light One lane each direction with one left turn lane in each direction. On the lane going the opposite was a city bus, going straight. When the light turned red, my son turned left quickly, long before he was in the path of the bus, They are VERY SLOW starters. The Local law says SHALL YIELD RIGHT OF WAY TO ANY VEHICLE APPROACHING (no sure he was even moving yet) WHENEVER VEHICLE IS WITHIN THE INTERSECTION SO CLOSE AS TO CONSTITUTE AN IMMEDIATE HAZARD. The bus did not slam on breaks not was their close to an accident. YOUR ADVICE PLEASE. The cop did not interview the bus driver or get the bus #. I can try to Subpoena the driver, the bus company knows who was scheduled to be driving at that time. He admitted to the cop that he knew bus had right of way. I doubt the cop could see break lights on an indication bus breaked. as the cop was next to my son in the straight thru lane. Last edited by gobcats; 06-25-2003 at 09:51 PM. |

| You present no evidence the ticket was not warranted. Testimony from the bus driver or the driver's actions played no roll in the ticket being issued and probably would not even be allowed in court. My suggestion, buy all those affected bus passes till you all can afford to drive legally and follow the laws of the road. |

| Is it not OK to turn left on a green light if you do not create a hazard to oncoming traffic and create a situation requiring the oncoming traffic to take ANY action to avoid the alleged hazard? Why would the bus drivers testimony not be relevant or not be allowed? |

| Cop says it was an illegal turn=guilty. Your first post said he turned left on red and then later you said on green. The first case would have been legal if he was already in the intersection and completing his turn. If he turned left on green in front of the bus what the bus driver says, if you can find and suponea him to court, will be of little use. I doubt that he even remembers the incident. Contact the clerk of court and see if he is eligible for traffic school. Sounds like he needs it. If you are going to make an illegal turn at least be sure you are not next to a cop. If that doesn't work find out what shift the officer works and meet him at the start or end of his shift at the station. Explain the situation to him and see if he will reduce it to a non moving violation. If that doesn't work it may be worth your while to hire an attorney and let him try to work comething out with the judge. |

| MY MISTAKE IN FIRST POST, he turned left on the beginning of the GREEN light, first car out. He turned prior to the bus moving. I could care less if the bus driver remembers, that is an indication that there was no risk of an accident. |
