Incorrect Race Listed on Virginia Uniform Summons


My fiance received a ticket from a Virginia State Trooper for speeding on I64, in York County. She was doing 77mph in a 65mph zone. Her ticket incorrectly listed her race as "Hispanic". She is actually 1/2 Italian and 1/2 East Indian. (Apparently the cop looked at the color of her skin and thought she was Hispanic.) Is this a possible basis for ticket dismissal, or will she still be stuck with it?

The race listed is purely for statistical purposes...it is not a method of identification.
