ip83 and the unsigned citation

When you do not sign the citation, for whatever reason, that does not negate the charge he is making, and the fact of his turning in his copy to DMV means you will almost certainly be held to responsibilities, as described on the citation. Having not signed the citation means only that you have not formally agreed, bonded yourself by your word, to meet those responsibilities. If you don't meet those responsibilites, voluntarily as it were, there will likely be a warrant and higher penalties for you to pay in the end. As always, it is best to get a lawyer, but short of that you can take a sound and reputable witness, sit in the court at the appointed time (if you elect not to just pay up), and wait for the state to do it's thing with regard to the citation. If they call you, present whatever case you have. If they do not call you, tell the clerk your name, in front of your witness. It must be established, without question, that you did your part....fulfilled your responsibilities as instructed. Failure to comply carries worse consequences than the traffic charge itself.

If you communicate with authorities, in advance of the court date stated on the citation, that alerts the state to a small glitch in the ticketing process in your case, but your responsibility remains as it is...to comply as instructed.
