Exclamation

MA state officer wrote wrong speed on ticket (Hearing Tomorrow!!!)

Massachusetts. I have a hearing tomorrow for a ticket I received a few months back. I was on my motorcycle on a two lane road (rt. 114) that was turning into one lane. I was attempting to pass a line of cars that was going too slow and didn't want to be stuck behind them for a while. The second car in the line was a state police officer (didn't know this before I began to pass but had already comitted). The officer wrote estimated 50mph on the ticket which sounds about right. But, we were in a 45mph zone and the officer wrote 40mph zone!!! I really dont have a good way to prove this in court. I did take a picture of the sign that marks the zone, but all that is written on the ticket is that we were on rt. 114 East in North Andover. The problem is that a few miles back there actually is a 40mph zone on 114 in North Andover, even though I was never actually on this part of the road. Should I even bother to bring this up in front of the magistrate or will this just anger him since I am accusing the officer of being wrong. Please help my hearing is tomorrow!!!

Colin

Tell the prosecutor you will plead guilty to the 45 ticket if he amends it; if not, then ask for a jury trial.
