Minor driving w/permit not license

What is the name of your state (only U.S. law)? CA

Our 16 year old took his sister's car out for a joy ride and ran it off the road. There were no injuries or damages to property. He was in possession of a legal driving permit but not a license. He could not contact us, so he called the police. He was cited for CVC 12500 unlicensed driver and the infraction was noted. Several weeks later, we received a letter from the County Probation Department regarding the charge "12500 (A) VC-Misdemeanor" which is not accord with the citation. We are to appear at the youth assessment center to discuss this matter and determine what Probation services if any may be needed. We are concerned about the notation discrepancy of misdemeanor and what problems this may result in. What advice can you give us as to what to expect and how to protect our child's record?

CVC 12500 IS a misdemeanor. It can be charged down to an infraction as well. If it is being handles as a juvenile matter, there is a great possibility of diversion as opposed to a criminal conviction, and it will likely be dropped to an infraction as well.

You can always hire an attorney.

Understand the police could probably have charged him with auto theft or held the car for 30 days because he was driving unlicensed. It is likely he will not see his license until age 19, at least, if convicted.
