Missouri suspension while in Michigan


My Missouri license was suspended in 97 for Failure to Provide Proof of Insurance. I paid the fines in 98 and, according to the Dept of Revenue, my driving privileges were reinstated as of Jan 7, 99. The problem is this: In March 1999 I moved to Michigan until Sept 2003 when I moved to Kansas. On Jan 6, 2004 I was pulled over in Missouri for speeding (my fault) and arrested for Driving with a Suspended License. Apparently, in Sept 1999, Missouri re-suspended my license for 'Failure to Maintain Proof of Insurance'. I'm perplexed because I was not LIVING in Missouri at that time. I had moved to Michigan, and had Michigan insurance in Sept 1999. When I called the Dept of Revenue in MO last week after the arrest, I was told that I no longer had to provide proof of insurance to MO (DUH). I have a court date in Feb, can I fight the second suspension & fine since I did not live in Missouri at the time? and had surrendered my MO license to Mich in May 1999?

Sure you can. But you'd better have proof that you surrendered your license and written confirmation from the Missouri DMV that you were no longer required to carry insurance in Missouri.

Jeff City isn't that far to drive depending on where in Oz you are.

Also, a copy of your insurance policy and a letter from the company stipulating WHEN the policy was begun would also help.

Just a question I forgot to ask? Did you register your car in Michigan and turn in your Missouri Tags?

I have a copy of my Missouri Driver Record that states 'Driver license has been Surrendered Out of State' and right below that it states 'Missouri license was surrendered to Michigan'. There are no dates as to when the license was surrendered, but I have a copy of Mich Driver Record that has an issue date of 5/7/99 for MI license. I did register my car in MI at the same time. I do have a copy of my MI insurance policy dated 6/3/99 as well. The only thing I don't have is written confirmation from MO stating I no longer had to carry insurance. I was only told that on 1/6/04 when I called to find out why my license was re-suspended. I was told I no longer had to provide proof of insurance, but that I had to pay the fine. I don't understand why I should have to pay the fine if I wasn't living in MO at the time! What a mess!
