need advice for careless driving and mipMy 18 year old son was coming home around 2am. He tried to avoid a deer and when into a ditch. After walking home(only a short distance) I told him to have the car towed in the morning as long as he was okay. Around 10am he went to meet the tow truck. The driver said he had to call the sheriff to make a report because of damage to the car(for insurance we thought). The sheriff took the info and said he was going to do a breathalyzer test. My son admitted to having a few drinks. He received a ticket for careless driving and minor in possession of alcohol. We have to contact the court within 8 days. My son had just got his license back 4 days before this incident. It was suspended for too many point during probationary period(michigan law;he has10 points for speeding tickets). My problem is that I want my son to be punished so he will understand the importants of not drinking and driving.But he just got accepted to a good apprenticeship progam with mandatory attendance.Do you think there's any chance for him to be punished but still be able to drive to this program or is his record too bad? | My advice, buy him a bus pass. It is obvious that the previous suspension did not work and he has no regard for the laws of your state. Standing out in the rain waiting for a bus on a cold morning has a way of making some folks realize that they need to change their ways. Worked with my son. Good luck. |

Thanks, racerThanks for your response racer. I had the same response at first too. The problem with that is, this is an apprencticeship with the electrical union. Which means the job sites are all over the southern part of Michigan. Some times two in one day. The job he reports to this week is 1 1/2 hour drive from our home. He must also get to electrical training school twice a month. My goal is to get him through this incident with his career in tact, and get him out on his own. If there is no chance of him being able to at least drive to and from this program, I'm afraid he will never be out of here by the age of 20(family rule). |

| First of all, don't EVER incriminate yourself to a cop. Second, if he crashed at 2 a.m. and went to the car at 10 a.m. why didn't he just not say anything and take the breathalyzer? Unless he was boozing it up from 2 on or was REALLY smashed when he crunched, he'd blow some serious green. Finally, get the car out of the ditch yourself. You'll save time, money, and hassle. As to your question, I looked but couldn't find anything useful in Michigan's laws. I didn't even find a definition of "careless driving". I'd get a lawyer and see if you can't get him out of one or both of these so his license doesn't get suspended in the first place. If you want him to pay for his actions have him pay for the lawyer and to fix the car. Paying a bunch of money to the state probably doesn't do anybody any good. |
