Need Help, I recieved my first ticket today.


What is the name of your state? CA

Hi, I just moved to Oakland CA from NY and just redone my license in California. I have never recieved a ticket in my life, tonight.. friday the 13th was my first. My house driveway is just across the i-980 freeway exit, it was 9pm and I was going to make a trip to McDonalds. I had no need to get on the freeway at all. I started driving out of my driveway, all of a sudden I saw a dog running in the middle of the street near my car. My first reaction was to avoid the dog, so I swirved onto the freeway ramp. No cars were around at the time except one, and he was at the red light. As I went on the ramp, regaining my composure, lights started flashing and.. it was a police officer. He gave me a ticket for 22107 VC. He didnt give me a chance to explain what happened. He wrote on the ticket "Unsafe turning movement."

What should I do? go to court? plead not guilty? pay the fine (how much is the fine anyways?)?? go to traffic school?

Please Help.

Of course, that is up to you. If you feel you have a valid defense to the charge (I didn't see one in your post), then by all means, go to court and present your defense. If you don't, then contact the court and ask about a deferral. If the court allows, do that. If they don't, then pay it. As for how much.... call the court. Pretty simple, huh??

The 'dog in the road' bit is very overused. Even if true, I doubt a court will believe it. But, you may have nothing to lose by trying it ... except for, maybe, the option of traffic school (which is usually NOT available after a challenge in court).

yeah i figured it was overused.. but still the truth none the less. The dog's owner lives in the apt upstairs. It's a small dog, thats why I didnt see it well. Basically, I guess it comes down to a moral issue when I made the decision to swirve onto the ramp or to run over the dog; the best thing I could have done was slam the brakes...but my natural impulse was to avoid the dog. Isn't there any type of defense I can build at all with this? I'm really worried. I've never had a ticket in my life.
