new cdl law in texas


What is the name of your state? texas, i received a citation for speeding but according to new law on 9-1-03 i cannot take defensive driving or use deferred adjudication, i am not a truck driver , i teach school , but drive a bus occasionally. is there any thing legally to do?

This is a Federal law that has been mandated for CDL drivers. The state had no choice but to adopt the Federal requirement.

For CDL drivers traffic school and the "masking of tickets" are no longer allowed. Some states are still allowing traffic school if you were not driving a CMV. Talk directly to the judge and explain your situation. He may reduce it to a non moving violation depending on the speed you were driving.

**A: please state the posted speed limit and the speed as noted on your ticket. Are you saying that you would be driving a school bus in connection with your employment as a teacher?

posted speed 50, ticketed at 70, but it was in a rural setting. was very much set up to be a speed trap. yes, a cdl is a requirement to being employed at my school. i do not drive a bus every day (route ) only on occasion for trips out of town.

If you have a CDL this is classified as a serious violation. Two serious violations within a three year period and your CDL is suspended.

This new law is going to be a boon to the insurance companies who use a speeding ticket as an excuse to boost your premiums.
In the past you could keep your record clean by traffic school etc. but the government has put an end to that for truck drivers. You need to try to negiotiate this to at least an under 10mph violation.
