Question

Hi. My question relates to the state of New Jersey's policy of charging an 'insurance surcharge' on certain violations. In 1999 I was charged with and convicted of driving while suspended (1st offense, although my NJ driver's licence was suspended in 1991 due to unpaid parking tickets I have not owned a car nor had I driven more than 10 miles in 10 years). I pled guilty and was charged a manditory $500 fine. Although I have to admit that the penalty ticked me off a bit as that was twice what many of the drunk drivers in court were fined I paid it.

The only problem is that now the state of NJ is looking to charge me $250 a year for 3 years as an 'insurance surcharge' which clearly I would like to avoid paying (I'm the first to admit I made a stupid mistake but IMHO $1250 is a bit stiff in this case). My primary question is does the fact that I am no longer a resident of NJ (nor was I at the time of conviction, I was in the process of moving from NJ > PA at the time I was stopped) have any bearing on this? I noted at the NJ DMV website that surcharges for DUI's are levied on both residents and non-residents but it didn't make it clear regarding other offenses. TIA.
