NY Statute of limitations: Unsafe speed


What is the name of your state? New York

I received a ticket for unsafe speed in march of 2000 on Long Island. I recently attended court for another incident(no insurance card), and the attorney brought up the ticket I received in 2000, as I never resolved the ticket. I have a court date for 8/29/03. My question is that this infraction was 40 months ago; driving infractions in New York State only stay on your record for 18 months. Is there a statute of limitations on being charged with an unsafe speed ticket? If so, how long do they have to prosecute?

You need to check with a New York attorney as to the statute of limitations....

BUT, since you didn't appear for the initial charge and have never paid the fine, the ticket continues to be unsatisfied. I have a feeling you're going to find out that a court date was set and you failed to appear. Which means there is probably a bench warrent out and will remain active until you are (were) caught.

Just pay the fine and get this behind you.

I don't think that there is a bench warrant, because I found out about the ticket when I appeared in court, and it was adjurned. If there was a bench warrant, they would've arrested me when I appeared and had me stand trial right there. The D.A. also didn't mention anything about a bench warrant being issued. Anyone know about the statute of limitations?

There is no SOL on traffic tickets. NY is very slow when it comes to dealing with unpaid tickets.
