NY ticket w/ a PA license--first ticket--need advice!


What is the name of your state? Pennsylvania

I live in PA and few weeks ago, I was pulled over in Sidney, NY for speeding. I was going 88 in a 65. Not that it's a useful excuse, but everyone else was going the same speed as me.. i just happened to be the one who was pulled over. This is my first ticket in my 5 years of driving. Since I live in Pennsylvania, I am not able to appear in court so I was planning on mailing my ticket back. However, I am not sure how to plead. Also, is it true I won't receive points on my license since my ticket was issued in New York? And, how will it affect my insurance, and what are my options with driving schools? Any advice would be great!

You can verify with the PA DMV but I don't think they post out of state speeding tickets on your record. If that is the case then there will be no points or insurance rate hike if you just pay the ticket.

In NY you can plead guilty on the back of the ticket, send it in and then they will tell you how much money to send them.

thanks for the advice.. do you think there is a chance they will reduce the fine? i'm scared its going to be a nasty one!!

Go to your local library and get a copy of ******dale-Hubbell directory and look up the attorneys practicing in Oneonta, NY (county seat of Delaware county). You might also just do an Inernet search. Since your ticket is remote from your residence, let the attorney do the work for you.

you may also want to contact Casey Raskob, III at (914) 271-5383 (daytime). He is in Croton-on-Hudson, NY, but may have a colleague out west near Sidney.

Question

you really think i need a lawyer? i didnt think that was necessary... won't it end up costing me more in the long run?

Whether you need a lawyer or not is up to you. The considerations in favor of the lawyer are (1) the distance from the citation, (2) possible reduction in the fine, (3) possible avoidance of a "moving" violation and therefore reporting back to PA, and therefore (4) avoidance of PA assessing points to your license. The drawback to a lawyer is the cost. However, it costs only a phone call to initially consult with one.

If it gets back to PA, 23 over is 4 pts and is not reckless.

One of the notes might be of interest to you:
(c) No points after six months.--The department shall assign points to the record of any person within six months from the date of a conviction. Any points assigned after such six-month period shall be null and void.

I would still check with a local lawyer to be sure of the risks.

Pennsylvania will not post out-of-state convictions for minor traffic violations to your PA record. However, if you fail to respond to the citation or the NY violation is enough to suspend your license in NY, PA will give consideration to suspending your PA driver's license which of course will reflect upon your PA record.

As far as responding to the citation via mail and reducing the fine, I can't offer any assistance as I am unfamiliar with NY law.
