WHETHER THE TRAFFIC SPEEDING TICKET ISSUER (OFFICER) IS ALLOWED TO CHANGE A CITATION (ISSUED AGAINST THE DRIVER) FROM “THOUGHTLESS DRIVING” (SECTION 14-506 CITY ORDINANCE) TO SPEEDING (S.C. CODE ANN.§ 56-5-1520, SPEEDING), AFTER ALLEGED VIOLATOR MAKES TIMELY OBJECTION TO FAULTY CITATION AT TRIAL (BEFORE MAKING PLEA)?

please help!!!

In South Carolina many cities have a local revenue ordinance that allows them to collect the money and the ticket is not turned in to the state. This means no points on your license.

If you contest the ticket they punish you by changing it to the state statute and then the city judge finds you guilty. It is legal and the officer can issue a new ticket if the orginal one is dismissed because of an error.

You might want to consider a not guilty plea and requesting a jury trial. They will then probably allow you to plead guilty to the original charge or they might not. Some towns have written so many of these tickets that they cannot get six people without one of them being upset about a ticket they received.
