Oklahoma tickets from 1999 & 2000


What is the name of your state (only U.S. law)? Oklahoma is where the violations took place. At the time the violations took place I was a resident of Oklahoma, using an OK DL. I am now living in another state, using a DL from that state. Between the times of the violations and now, I have lived in 2 other states & had thier DL's before coming to this state. I have also had no issues with getting my DL renewed in my current state of residence either.

In August of 1999 I received 2 violations. One for speeding 1-10mph, & the other for failure to show proof of insurance. Then in February of 2000 I received another ticket for speeding 1-10mph.

These violations were for Oklahoma City MUNICIPAL court. There are currently 3 bench warrants out for my arrest. As Oklahoma City does not & will not seek extradition with the state I am currently in I am not worried about arrest. I am not worried about the tickets ending up on my Driving record (As that would only be in Oklahoma) & therefore would not affect my insurance premiums. As my insurance company only checks my driving record for this DL and state.

The cost of all 3 tickets is a little over $700. (Assuming I just paid the Fines & Court costs online)

What I want to know is IF it is still POSSIBLE to fight these tickets with a TRIAL?

The reason I ask that, is I beleive I could win, as the officer who wrote the tickets (all 3) is now deceaced. Conincidence that it happend to be the same officer who wrote me the ticket again in January of 2000.

In the state I am currently living in, if the officer isn't present for the trial then the case is dismissed. In our state it is required for the officer who issued the citations to be there in court to testify. If they aren't the case is dismissed. (I know this from experiance, as I have since had two citations dismissed because the officer failed to show up for court).

The ONLY reason I was reminded of these citations, is because I just recently moved into a new house & was cleaning out some old boxes & file cabinets & ran across the copies of the old tickets. I did a little investigation work & found out what the current status of the citations are from the Oklahoma City Municipal court & the fact that the officer who issued the citations is now DECEASED.

Generally speaking, since you fail to pay or show up in court if that was required for those ticket, you have essentially plead guilty to the charges. If that is the case you no longer have an option to fight the tickets in court and any appeal option that might have been available to you most likely had gone away too.

I will tell you this you are miss guided in your believe these tickets will not cause you problem even in your current home state. In the last few years all DMV database from state to state have been or are being connected. If it has not shown yet, they will show up in your home state. Both states have your social security number and they will link up and your home state will see you have out standing tickets in another state and they will most likely suspend your license until you clear the matter with the other state.

If you do not believe me, just search this forum for all the thread on this subject about old ticket all of suddenly showing up from other states and people having their licenses suspend or were not allow to renew until those old tickets are paid.

I agree with Maestro... Look up "Driver's License Compact". Unless you current home state is one of the few states that are not members, you are VERY misguided.
