Ticket Issued: Fresno County, California

I recieved a ticket for for passing within 100' of an intersection as described on the ticket. The officer cited the wrong vehicle code on the ticket. The description of the violation does not match the match the cited code. The code on the ticket is (21752 (c)) passing within 100' of a railroad crossing. The officer should have cited vehicle code (21752 (d)) passing within 100' of an intersection.

Can the ticket be thrown out on a technicality?

I would certainly try and believe it should be thrown out but as always its up to that judge.
