plea bargaining (first speeding ticket)


What is the name of your state? NY

I got a ticket for 77 in a 55 mph zone on the interstate in upstate NY. This is my first ticket.
I have pleaded not guilty and requested the reschedule of the court date. I received a letter that stated " if you wish to seek an alternative deposition (plea bargain) you should contact immediately the supporting staff of the ... DA office" and the contact phone number.

Does this mean that a DA will make a plea offer over the phone? Do I have to accept/decline it immediately or will I have time to think? Can I negotiate? Is it possible to get a no-point violation in my curcumstances? Do I have to explai why I pleaded not guilty?

In the letter, it was stated that if they won't hear from me before the certain date they will proceed with scheduling date for the trial - Does it mean that if I accept the plea bargain I won't have to go to court?

any advice is appreciated

What did they tell you when you called that number?

I haven't called yet. I am now outside of the US that's why I requested the rescheduling the court date. I am trying to find out what should I expect when I call. Will the bargain take place over the phone or not?

many NY courts are backed up, some as much as a year. They will usually offer you a reduced fine/points. Whether to accept is up to you.

My understanding is that if a state trooper wrote the ticket, there will be no plea bargain offered. If written by a town/city cop, you can expect they will offer something. Feel free to counteroffer if you don't like the original one, but be aware that they might take the plea off the table if you do.

I have called the DA office and was offered the change for 2 point violation (instead of 6). I asked if I can get a no-point violation, the answer was : "go to court and win". I have accepted the offer. I was told the fine will be determined by the court.

2You Are Guilty: I was stoped by a state trooper on the interstate road.
