Question

Police Report

What is the name of your state? KY

Ok I am confused now as to how the police can report false information in his report. I had an accident. The cop stated that I was travelling at a high rate of speed. How can he say that as there was someone in front of me that was driving there for 5 - 6 miles and I had just stopped because of someone in front of them was turning about 1/4 mile from where I flipped. Now I drive a Kia Rio and if it can go from 0mph to a high rate of speed in a 1/4 mile then wow I had better get another one and race it. How can the cop determin how fast I was going? The only black mark on the road is from a truck that I swerved to avoid as he came across the yellow line. I know I rolled the car 4-5 times but this is because there was no guard rails at a 10 - 15 foot drop off.

I think the cop is just saying that as he didnt want to look for this "Phantom Truck". (the truck sped off when I wrecked) How can I get the state to place guard rails at this area? Will I need to sue to get thier attention? Man I am so bummed about all this crap.

What is left of my car.---> http://www.cardomain.com/memberpage/480891

"How can the cop determin how fast I was going?"
*** The officer makes his ESTIMATION of speed based on several factors. Some are: witness statements, extent of damage to the vehicles, physical evidence such as skid marks, etc.

"How can I get the state to place guard rails at this area?"
*** You can certainly contact the road 'owner' (federal, state, local) and ask that they investigate the safety conditions and install rails if warranted.

Did the report include a ticket? You can challenge the officer's report by challenging the ticket.

You should also notify your insurance company that you dispute the officer's conclusions & give them your statement of events. Take pictures of the skidmarks; you might want them later.
