It depends ... who is conducting the background? The corner market, or a government agency?

If it's a government agency where the background of their people is important (police, sheriff, welfare, etc.), it's almost certain that they will find out about it. If it's a local store that does a records search via Lexis-Nexis and other services of public records, then there is a good chance that pending charges won't pop up ... yet.
