an auto was parked in the turn around point of our driveway. i had no way of knowing he was there. he was on his cell phone.
i backed into him with my loud diesel truck. he was in a small car.
i didnt ask him to be on my land, do i have to pay him?

My response:

You're the one at fault. You have a duty to make sure that you're clear to move your vehicle before you do. People come to other people's homes for various reasons - - friends, salespeople, family members, etc. They all have a right to be there for the limited purposes of their visit, until they are asked to leave the premises.

But, as long as they are on your property lawfully, you don't have a right to just smash into someone else's vehicle.
