The prosecutor’s scare tactic


What is the name of your state? Idaho

Back in May I received a ticket for off-roading in a national forest, and I decided to challenge the ticket which was for $100. So yesterday I get a phone call from the federal court house and it’s the assistant prosecutor. She tries and tells me that if I loose my case I will have a federal conviction down on my record for the rest of my life and that I will have a hard chance to get in any government job, such as the armed forces. Later in the conversation she was saying all this BS about all this stuff they have against me. Such as the sign she says which is clearly visible that says vehicles are prohibited, but the funny thing is she never has seen the sign and I have pictures which show that the sign which is around 25ft up in a tree is difficult to see due to the tree’s branches being in the way. So later that day I go down to the national forestry building and talk to some rangers there and they were telling me that she is full of crap and that the fine would have to be over like $3000 for it to be a felony then it would be difficult for me to go into a gov’t job. Since I’m only 17 years old I came to a conclusion that the assistant prosecutor was trying to make me get scared and back down and just pay the $100 fine. So isn’t illegal to do what the assistant prosecutor was trying to do to me, and if it is what is the law called.

Speak with an attorney in your area. You are not equipped to be fighting this issue with the government attorney.

*** Though what you claim she did may have been of questionable ethics.... in itself it is not 'illegal'.
And I agree with Hex. And at 17 years old, you need to get your parents involved in your problem (if not already). The courts won't (or shouldn't) even be talking to you.

Is she trying to charge you with something else if you go to court? If you just pay the ticket that's the same as confessing. Your "criminal record" would be no different than if you went to court to defend yourself unless the prosecutor is threatening to charge you with something else.

First and foremost it sounds as if you got a CFR or Code Of Federal Regulation ticket. The Assistant US Attorney does not handle any sort of pre trial arraingements as that is done thru the US District Court Clerks office. It sounds as if someone is bs'ing you. You will need to get your parents involved as the court will not allow you to come forward as a minor. Your parents will need to show the evidence and appear in your defense as you are a minor.

As far as a federal conviction, it is true you will be convicted of a federal crime however its nothing more than the equivalent of a traffic ticket.

Idaho state law can not be used in this case.
