Question about running a red...I live in CA. And i recently got a ticket for running a red light, but there are other circumstances behind it, there was a person making a left in oncoming trafic who made that hesitent move to make the turn but there was a car in back of me so if I slammed on my brakes I would have caused and accident, but I applied the brakes so I ended up rolling through the intersection at 26 mph. What are the odds of the court finding me not guilty? More importantly is this counted as wreckless or careless driving? or is it just a standard moving violation? I wasn't drunk, just in the wrong place at the wrong time. Please help. |

"More importantly is this counted as wreckless or careless driving? or is it just a standard moving violation?" -it would depend on what code section you were cited for. it would be either: 21453 (a) CVC (Red Light): A driver facing a steady circular red signal alone shall stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown, except as provided in subdivision (b). or 23103 (a) CVC (Reckless Driving): Any person who drives any vehicle upon a highway in willful or wanton disregard for the safety of persons or property is guilty of reckless driving. (b) Any person who drives any vehicle in any offstreet parking facility, as defined in subdivision (c) of Section 12500, in willful or wanton disregard for the safety of persons or property is guilty of reckless driving. (c) Persons convicted of the offense of reckless driving shall be punished by imprisonment in a county jail for not less than five days nor more than 90 days or by a fine of not less than one hundred forty-five dollars ($145) nor more than one thousand dollars ($1,000), or by both that fine and imprisonment, except as provided in Section 23104.
