Question about Washington State Law


after getting a traffic ticket does the ticket have to be processed within 2 days or it can be throw out because it wasnt procesed in time?

What kind of moving violation and what do you mean by processed? On some moving violation tickets you are given the oprion of paying the fine, others you must go to court.

i meant filing the traffic citation. i heard that if it was filed by the cops/courts within a certain time period then you can get the ticket thrown out? is that true? i recieved a ticket for speeding 10miles over the speed limit. i truely doubt i was going that fast because i had just come off a stop light but i wasnt looking at the speedometer. so i cant say for sure

The ticket is suppose to be processed in 48 hours (not including weekends and holidays) or it can be discharged. But there are a 1001 valid reasons for the processing to be delayed. It is up to the judge if the officer has a valid reason or not.

is this true for all courts? in the king county area? and what RCW would this be?

Your making me work for this one. The Washington state RCW does not set anytime limits for the filing of the citation with the court. Only that the citation be filed in a timely manner. For unincorporated King County, the officer has up to 2 days prior the court date on the citation to file the citation with the court. This can give the officer from 30 to 45 days to file the citation depending on the court case load. The city of Seattle was a little more difficult to get info from but an officer told me that department policy is 14 days to file the citation but that can easily be extended. During the famed WTO riots, the filing deadline was extended to 60 days. Other jurisdictions have there own policies and it is a wide variety of time periods. I attend traffic court at the RJC and Aukeen courts in Kent on a regular basis and have never seen a citation dismissed because it was not filed in time.
