Radar on Private Property


What is the name of your state?VA
I was recently cited for speeding 44 in a 25. The Officer was sitting in a private driveway running radar when he stopped me. Isn't the Officer required to have the express written permission from the home owner prior to running radar from his drive way?

And my question, shouldn't someone follow the speeding limit in an obvious residential area?

What does that matter to you? Whatever "deal" the property owner had, or may not have had, with the cop has nothing to do with your ticket, and is none of your god-damned business!

No. The last I heard, an officer in VA does not need such permission.

You can always fight the citation and try to bring that up, but I suspect that if you use that as your sole defense, you will be found guilty.

If you really must fight the ticket, I would suggest an attorney experienced in fighting radar citations ... and, be prepared to pay a pretty penny. You can always fight it yourself - there ARE a number of self-help books out there, but they can often give you just enough knowledge to get you in trouble.

It's up to you.
