Radar on Private PropertyWhat is the name of your state?VA I was recently cited for speeding 44 in a 25. The Officer was sitting in a private driveway running radar when he stopped me. Isn't the Officer required to have the express written permission from the home owner prior to running radar from his drive way? |

You can always fight the citation and try to bring that up, but I suspect that if you use that as your sole defense, you will be found guilty. If you really must fight the ticket, I would suggest an attorney experienced in fighting radar citations ... and, be prepared to pay a pretty penny. You can always fight it yourself - there ARE a number of self-help books out there, but they can often give you just enough knowledge to get you in trouble. It's up to you. - Carl
