Reckless Driving (GA 40-6-390) issues in vacant parking lot?


Citation issued in GA

Can a major moving violation such as reckless driving (40-6-390) be issued to a vehicle not operation on a public road/hwy?

I was issued the citation for "doing donuts" in an empty parking lot of a vacant building. The office didn't actually witness anything, but I honestly won't deny my actions. I simply feel that the fine ($380) is a bit harsh for actions that in no way endangered other drivers/pedestrians or the property (wet parking lot). The lot is technically private property but I believe the city has offered to look after it while it is vacant ... not sure how that gray area works.

The officer has recently offered to lessen the charge to "Laying Drag," but I'm not sure I should take it if I could possibly have the original charge thrown out.

Any help would be appreciated. Thanks.
