Restricted Liscense? Additional Suspension?


What is the name of your state? Arizona

I have gained quite an embarrassing list of speeding tickets over the last two years. Now I_m stuck in more of a bind then I could have ever imagined_

I will start off with my questions first and follow them with the violations:

1. Is it possible to get all violations reviewed under one license suspension hearing in order to avoid additional suspension time? How should I go about doing this? (I have a stop sign ticket from 04/11/2007 pending a court date on 06/08/2007.)

2. The judge informed me over the phone that I would be unable to apply for a _restricted permit_ (for driving to and from work) due to my specific circumstance. Is there anything I can do now so that I can continue to commute to and from work? Do I have any options here or am I stuck riding the bus?

01/09/2007 _ DI ACTION _ TSS ASSIGNMENT _ TSS COMPLETED

01/27/2007 _ TSS CERTIFICATE _ Successfully completed TSS approved by MVD.

01/30/2007 _ Received letter from MVD stating that I had failed to appear on a traffic complaint that was from 09/07/2006 _ 28-701A, at this time driving privilege was suspended. Went to court; paid ticket - went to MVD; paid to have driving privilege reinstated.

01/30/2007 _ CS ACTION _ Suspension Satisfied (This was listed on Certified Driving Record) (Paid for ticket that was missed on 09/07/2006)


03/20/2007 _ SUSPENSION NOTICE- On 03/20/2007 I received a letter from the MVD stating that on 04/09/2007 _ 07/09/2007 _ Statutory Authority: 28-3306 indicates that I have been convicted of serious or frequent moving traffic violations, and that my driving privilege has been suspended for 3 months.

03/21/2007 _ Letter sent to MVD Exec Hearing Office _ I requested a hearing to have the action (suspension) reviewed.

03/30/2007 _ HEARING NOTICE _ On 03/30/2007 I received a letter from the DOT Executive Hearing Office stating that an administrative hearing will convene on 04/26/2007 to determine whether the order of suspension issued by the department was supported on the evidence. This hearing was conducted by telephone.

04/11/2007 _ 28-855B _ Failure to Stop For Stop Sign (I was in a rental at time if that makes a difference) _ Still Pending June 8th, 2007 Court Date *(Had to request a continuance via telephone)+++

04/26/2007 _ PHONE HEARING _ Called into the Exec Hearing Office for phone hearing regarding license suspension. Judge was very brief, basically summarized tickets received and stated that tickets had posted since I took the TSS Course that caused the suspension to be ordered. ***(I recall being informed while taking TSS that the class would _apply_ to any tickets up to this date and that if I received any tickets within the next year I would then have my license temporary suspended. _ This seems to not be the case after speaking with the judge over the phone???)

05/08/2007 _ HEARING NOTICE _ On 05/08/2007 I received a letter from the DOT Executive Hearing Office stating that an administrative hearing will convene on 05/30/2007 to determine whether the order of suspension issued by the department was supported on the evidence. (I thought this already happened on 03/30/2007, is this some sort of automatic appeal? Or is this for the stop sign ticket informing that I will have additional suspension? I_m still unclear on exactly why I received this notice.) This hearing is also scheduled to be conducted by telephone.

Don't any of these classes sink in at all?

Restricted licenses are entirely discretionary. Your repeated violations (even in light of breaks given you with two trips to traffic school and the charge reduction) and your FTA on a violation, sort of predisposes them not to offer things to you.

Curt is right, you will need an expert's help in negotiating with the DMV on this one I think.

And don't even think about driving on the suspension.

You need a lawyer who specializes in AZ traffic law (preferably one familiar with your county court) to sort it all out. He'll be able to do things, like hearing schedule changes, that you won't.

First off, thank you both for you helpful insight and timely responses. I guess I forgot to mention that I am really in a bind here because of my financial situation, [being 20 years old w/ a practically minimum wage job, and plenty of bills] is making me seriously doubt that I will be able to pay for any lawyer.

If I am forced to go into this alone what can/should I do?

Oh yeah, renting a car gives relieves you of the obligation to follow the traffic laws, and if you're in an accident, who cares, it's a rental.
