What is the name of your state? TEXAS

I was pulled over last night at 10 pm for taking a right on red. (Failure to comply with posted sign: No Right on Red). Obviously I shouldn't have done it, but do I have any room to argue?

1. It was 10 at night, and there was no traffic. I approached the light, looked to the left and saw no cars coming, and turned. That doesn't make it okay, but I didn't see the sign because its up above the traffic light, and I had allready begun to go through the actions to turn right. (pull up to light, stop, look for traffic, and turn).

2. Once you've gotten a ticket the sign if visible, but its definitely something you don't see, if you don't have any reason to wait at the light, so I would also argue that the sign if not in the best spot for me to see it. If there was a sign on a pole next to the intersection, that wouldve been at my car level and I wouldve seen it before I turned.

Those are just a couple of the justifications going through my head. Any ideas? Thanks

**A: if the sign is in a location that cannot be seen by a driver prior to turning at the intersection, it may very well be restricted from view. If that is the case, you could make an argument in court. Your evidence would be photos, letter from traffic engineering etc.

I have no idea to be honest. He definitely followed me for 8 blocks before finally pulling me over.
