Question

right to a speedy trial in new york


What is the name of your state? new york

approximately a year ago(july 04) i received 2 tickets, one for failure to obey a stop sign, and one for having an expired inspection sticker. i received a notice to appear in court some time in october(oct 04), went to court, pled not guilty to both charges and requested a supporting deposition. At the end of these court proceedings the court clerk told me that i would be notified by mail of my trial date. so i expected to hear within a few weeks to a month about my impending trial, however i didn't hear anything else about the whole matter until 2 weeks ago when i received a letter saying i am to appear in court on july 11th to face these 2 year-old charges. Is this a violation of my right to a speedy trial? also i recently attended a defensive driving course in order to lower my insurance premiums, is this worth mentioning to the judge?

You stated this was July 4th of last year.

sorry, i meant these 2 one year-old charges...

You probably waived your right to a speedy trial when you requested the supporting depositions.

And what does this have to do with your immature moniker demeaning the police? It's the court that is giving you the runaround not the police.

I think you should have a T-shirt printed with that saying on it, and wear it to court on your trial date.

But I bet you don't have the stones to do it.

First, I've got to tell you, I LOVE your "screen name." With that attitude, I always give someone the yellow paper parade during a car stop. As we all know, it is the officer's fault when you are caught doing something, and therefore, we must "**** the police."

The speedy trial nonsense won't work. Did you get the deposition? If not, try to get a dismissal based on that. If you did, try and plea the stop sign violation out as it carries 3 points.
