| | Right Turn On Red- Is complete stop needed? This happened with me in Kansas few days back. I made a right turn on red signal looking at the traffic.
"No turn on red" sign is NOT there on the intersection.
I got a ticket as Stop/Yield voilation.
There was absolutely no traffic when took turn.
This seems I got the ticket for not coming to complete stop in this situation. My question is,
Do we require to come to a complete stop before taking right on red?
I think it's a yield which doesn't require a complete stop.
Please advise,

| | | Well I'm sorry to say that you were misinformed. You MUST come to a COMPLETE stop before you are allowed to make a right hand turn against a red light. |

| | | In just about every jurisdiction I've ever been in, any time you see the word stop, it means FULL stop.
Here's the definition of stop from the Kansas statute:
8-1471. "Stop" when required, defined. "Stop" when required means complete cessation from movement.
This means that you must do more than lock up the wheels momentarily. The car must completely come to rest to qualify.
The text of the Kansas statue follows. You must stop. The only thing that changes is when you can go again. In the general case you must wait for the green, when turning right you may proceed after yielding to other traffic/pedestrians. In both cases the stop comes FIRST.
(c) Steady red indication. (1) Vehicular traffic facing a steady circular red or red arrow signal alone shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then before entering the intersection, and shall remain standing until an indication to proceed is shown, except as provided in paragraphs (2) and (3) of this subsection. Any turn provided for in said paragraphs (2) and (3) shall be governed by the applicable provisions of K.S.A. 8-1545, and amendments thereto.
(2) Unless a sign is in place prohibiting a turn, vehicular traffic facing a steady red signal may cautiously enter the intersection to make a right turn after stopping as required by paragraph (1) of this subsection. After stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time such driver is moving across or within the intersection or junction of roadways. Such vehicular traffic shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection. |
