i received a ticket in a the mail today for running a red light on one of the cameras they have now. when i ran it i was turning right and i only yeilded and didnt make a complete stop. it says i was going 15mph the whole time. I dont knwo if this is a possible defense or not but the reason i ran the light was because i was trying to get the license plate of a hit and run driver that had just hit a car over the center divider and into oncoming lanes. i made sure it was safe to turn before turning and also got the guy's license plate number and called it in. is there any way i could fight this ticket for this reason?? |

| I doubt it. Being the witness of a hit and run does not give you the right to violate the law.

| | | Get documentation on paper of the hit/run (police dispatch records) and your call (your cell bill). I think a judge would give you a pass. I would if I was your judge, especially on a Mickey Mouse right turn ticket. (I'm not really a judge, though.)
For more red light camera info, google "red light camera ticket" and the name of your town.

| | | since it is only a 1 pt violation cant a warning be issued instead of a citation?? if i explain my story in court, could i ask for it to be changed to a warning or is that not possible because it was originally issued as a citation. |

However, keep in mind that he does not HAVE to give you a pass. Many judges and cops will look at your chasing after a suspect in such an incident (non-injury hit-and-run) as simply putting the public at even greater risk when you run lights or stop signs.
We often tell people following possible suspects or even DUI drivers at high speeds to back off for their own safety and the safety of others.

| | | about an hour after i posted my last response an officer from the tustin pd called me for my statement. i told him what happend and he said he will call the santa ana pd for me to see what he could do. so i guess ill find out if he can get me a warning after i call him back with my ticket number and information. | |
