Running a stop sign when there is no stop sign?!


I received a ticket the other day leaving a private driveway at a "T" intersection which has a three way stop. The only section without a stop sign is the private driveway I was leaving. Granted, I didn't stop leaving the private driveway, but there is no stop sign.

The officer wrote me for a 22450(a) (California Vehicle Code), which states:

The driver of any vehicle approaching a STOP SIGN at entrance to, or within, an intersection, or railroad grade crossing shall stop at the limit line, if marked, or otherwise before entering the crosswalk on the near side of the intersection.

But my ticket says:

Violations:
22450(a)vc/Fail to stop upon entering an intersection.

I don't contest that I never stopped. I contest that I was written for running a stop sign when one does not exist.

Can anyone give me any advice here. Should I fight this ticket?

My response:

. . . which means, you had to be turning left or right at the "T" intersection. Are there railroad tracks at the top of the "T" ?

Turning left out of the intersection. There is no railroad tracks anywhere near the intersection. The officer felt the need to give me the ticket because I "briskly" left the driveway and turned left. I wasn't speeding and there was no one waiting at the stop signs. I was basically leaving private property.

Like I said, my contention is he wrote me for the 22450(a) which clearly says "STOP SIGN". He must have meant to write me for something else, but that's not my fault!
