My husband received a ticket for failure to wear a seat belt. He was a passenger in a vehicle that didn't have functioning seat belts, the part that you attached the seat belt to was not in the vehicle. So, if he did not have the ability to wear the seat belt, can he fight this ticket? |

My response:
No. There is no defense. Simply, he shouldn't have gotten into a car with defective seatbelts.
The law is the law, and his situation is not an excuse or a defense.
