YOUR STATE NAME - jbiz in Wa.

The big click-it tickit push is on in some areas (all?) in Wa.
Its all for safty Right? Duh,, At $90.00 a pop I feel safer
already. They are using this as a primary stop and making
huge revenue. Taxation by citation? Extortion under color
of law? Are helmets next?
Anyway I'm a little confused after reading RCW 46.61.688
ss 7 Says they (cops) can't do that. So what if all the
victims were to demand discovery. Would that tie em up
for a while? And what about going after the cops that
violated the law? Should they be held to a higher standard?
Since that is their job. (to know the law)

Thanks,
jbiz

Well, if there is a compulsary seat belt law in your state (meaning the law says you MUST wear your seat belt) cops can pull you over for it, unless it is mentioned in the SAME statute that they can't use that as a primary reason too. Also, all 50 states (+ Washington DC) have laws that state police officers are exempt from following most civil laws (speeding, turn signals, red lights, seat belts, etc) while they are on duty, so no, police officers don't have to wear their seat belts. They could also use the "Commercial Vehicle" clause that states any non private vehicle in which the driver or passenger would frequently (no number or time is stated to define frequently) have to exit their vehicle are exempt from seat belt laws (that's why the UPS driver and Postal Service carriers don't have to wear seat belts).

The law as posted on the Washington state website has not been changed yet. The new law will take effect on June 13. The website will be updated within 90 days from when the law takes effect. If someone is ignorant enough to drive without wearing a seat belt, they deserve a $90 ticket.

Oh, and USPS drivers are required to wear seatbelts if the vehicle is to be driven more than one quarter mile without exiting the vehicle. They can be fired for violating that policy. That is why the seatbelts in mail trucks are bright orange.

Seat belts

Racer,

Your right it is June 13 that the pigs can do their extortion
"legally" Until then any victim can sue the scum for violating
the law. The law that they are paid to KNOW!!

But we do not have peace officers any longer ( witch I hold in
high regard) Today we have yellow bellied prostitutes in
blue out extorting money from the public, and as long as they get
their high pay they will still whore. Most have been brainwashed
to belive that "us" is the enemy and that they are a cut above.

By the way I am one of those "idiots" "fools" that never wear
an idiot belt. Started "driving" at 12 yr. old now 65 40K per
yr. You do the math. Never an acc.

I assume you are a cop, a liberal or a woman.
Surely you're not an idiot like me???

Very disapointed in you slick.

I am not a cop, a liberal or a woman. I did get broadsided by a large Cadillac while riding in a small pickup. I was wearing a seat belt, I would not be here today if I wasn't. I started driving race cars at 6, I'm 45, and I make about $80,000 a year. Been in 3 accidents, none my fault. You do the math, I won't be paying $90 either, I will always wear my seatbelt. If everybody wore seat belts, we would not have laws like these, pure and simple. Have a good day, Bubba.

apology

Sorry for my rude comments. Uncalled for.

Its just that I see our precious rights being eroded and
our way of life deteriating, heading to George Orwells
1984. I do not ever want to take the attitude "why should
I care, Its not my ox being gored" I believe in the common
law. Habius Corpus. If I refuse to shout out in defence of
my neighbor why should he come to my aid?

Anyway, let the individual deside what is best for himself
as long as he harms no one or their property.

Again sorry
