Speed trap from private propertyI live in Southern Illinois and recently received a ticket for speeding in a school zone. However, the police officer was sitting in the driveway of a private residence running the speed trap. Is it legal to run a speed trap in Illinois from private property either with or without the owners permission? My court date is in 3 weeks. Help |

Yes it is legal. Depending on your state laws, the 6 to 12' of propery next to the road is considered part of the right of way and the officer may use it for traffic enforcement.

So what happens when the homeowner comes back and tries to get in his driveway?

Homeowner asks the police officer nicely to "please move and do you want a cold soft drink?"

So, I'm turning left on a busy street into my driveway, and I'm supposed to get out of my car, walk over to the cop, ask him to move, and offer him a soft drink before I can get in my own driveway?
