Speeding 101+ California


Im in norther california.
I received a speeding ticket on my motorcycle for 101+ on the freeway.

I went to court, asked hte judge what fines I was facing he said he'd give me a deal of $1600 + 2 points on my record, but i only had to pay $800 up front, and if i got no more tickets in teh next two years, i would not have to pay the rest.

I thought this was a terrible deal. so I opted to talk to the DA.
I worked out a plea bargan with the DA, to drop it to a regular $350 fine and 1 point on my record exceeding 65pmh speeding ticket.

The judge refused this offer minutes later in court and said hed rather trya nd see me beat the ticket in trial than offer me that bargan.

I violated california vehicle code 22348 (b)

That vehicle code states that it is an infraction punishible by a fine NOT TO EXCEED $500.

How can the judge fine me $1600!!!????
what should I do.
I plead not guilty, and have a trial Dec 1.

The exact violation


22348 (b) exceeding 100 mph
(splitting traffic)


is what the officer wrote on teh ticket.

under approximate speed he wrote "101+"

The (splitting traffic) is just a side noteit would seem, and wasn't listed as an actual vilation of any kind. Just a desciptor of hte situation.

The officer did not write down anythign about Radar as they usually do.

All i can guess is that he Paced me, or visually estimated it since he did not write a spefic speed. he just wrote 101+

Why not write 105 if I was going 105? or 115 or whatever the exact speed might be if he had radared an exact speed?

and how does 101mph = $1600 and 99mph = $350, a 1 or 2 MPH discrepency doesnt justify that big a difference in fine?

He was in a regular Crown Vic cruiser.
If I was supposedly splitting traffic at 101+mph on a motorcycle, how was he able to catch me, follow me, or pace me at all?

none of this makes sense to me.

Quit your whining and pay the fine. Think yourself lucky he didn't haul you off to jail for wreckless driving.
