Speeding in California, officer refuses to show radarIn Fresno County, California: I am a commercial truck driver, I received a ticket for speeding in California and I in fact was not speeding. The chp was following me for 3 minutes and I saw him from when he drove onto the freeway. As he drove behind me I looked at my speedometer and it did not exceed 57 miles an hour. After following me for 3 minutes he turned on his light and pulled me over. I knew I was not speeding, so I asked to see the radar. He said, "I did not get you by radar." He still wrote up a citation and put that I was speeding at 65 miles per hour. My question is: If he did not get me by radar, how can it be proved that I was speeding. And how can I prove my innocence? Is what the officer did a "speedtrap?" |

| He most likely got you by pacing. He clocks you by verifying the speed you are going using his speedometer. If his speedometer reads 60 mph and he is behind you and needs to accelerate to catch up to you, then you were going faster than he, therefore faster than 60 mph. He can testify in Court as to the speed you were going and that his speedometer was recently checked by a certified mechanic and functions properly. |

| If the chp entered the ramp as you were going 57mph, you already have a head start on him. There is no way that he can catch up to you by just doing 57mph. In this case, the only way he can compare you to his own speedometer is by completely catching up to you and matching your pace. Not by how fast he had to drive to catch up with you. Laws of physics. |

| Have you made sure your speedometer is correct? If you had a mechanic do it you might bring that to court with you. Do you have a box in your truck that records your speed? (UPS trucks do, I believe) Were there any witnesses that you can find? In any case, take it to court. It's possible this guy has done it to others and the judge knows this. If nothing else, the cop doesn't want to show up for court much more than you do perhaps he won't or at least he'll learn that he gets more of a hassle when he burns people like this. |
