Speeding in NC


I was coming home from work at 3:30AM friday night when I was caught speeding 75 in a 55. I live in NC, I just moved here from VA, my lisence and plate are still registered in VA, I will be changing them over shortly. But is there anyway I can fight this? He was sitting on the opposite side of the road with his lights off, no parking lights on or anything, I dont know if they must have lights on or? I have no prior speeding tickets, I just turned 21. Should I get a lawyer or? I dont know the possible penlty either, I just know I must appear in court, or have a lawyer appear on my behalf. I dont want my insurance to increase, that is my main concern. Thnx!

There probably was nothing wrong with the stop from your description. 15 over or 80 or more can get you a 30 day suspension and double your insurance in NC so take it serious. There are two points systems in NC, one for your driving licence and one for your insurance. Read the links below for how it works.

An attorney can advise when a plea to a reduced speed or violation, a prayer for judgment continued (PJC), or other options that may be available and in a person's best interest. If you have no previous violations, they can probably go to court for you and plea it down to save you insurance money in the long run.

Don't be suprised when you will get a bunch of letters in the mail in a few days offering to represent you. This seems to be a good business in NC.

Someone I know with went through this recently and the attorney was able to get an 80 in a 55 reduced to a 64 in a 55, $50 fine, $100 court costs and $500 for the attorney. Saved her about $600 a year in insurance increases.

the ticket


What if I did not sign the ticket? Does that have any affect on it being thrown out or?

No. This makes no difference except in Texas. If you refuse to sign in Texas they will take you to jail.
