speeding and no seatbelt ticket


What is the name of your state? ky

i went to court today to dispute a traffic ticket (no insurance-dropped, speeding 75 in a 55-pending, and no seatbelt-pending). the no insurance was dropped upon proof. however, i was not speeding and had my seatbelt on the entire time. i go back to court on december 1 to see if there is a case and if i what kind of trial i want-bench or jury.

the trooper never even told me how fast i was going. it is possible i was going 5 miles or so over, but not 20. he walked off as soon as he said i was speeding. when he came back, he told me the charges very quickly. i immediately disputed the seatbelt because i never took it off, even to look for my license and insurance card. he told me to go to court. i was on a curvy road and wanted to look at the citation until i got to school (i'm a college student) and realized he told me wrong information. he said the fine was payable but the ticket was marked court. when he said it was payable, i thought he clocked me barely going over (which is why i didn't dispute that). he also gave me wrong information about traffic school.

i believe i have a case because the officer told me wrong information and never even told me how fast i was going. i am in the process of contacting an attorney, but wanted to have a heads-up on what is going on. should i get a bench or jury trial? it seems like such a minor thing to have a jury for, but the judge is tough (but nice).

The seat belt charge is a "his word against yours", and guess who usually wins. As for the speeding, the officer just needs to show that the radar was calibrated and working properly before he "tagged" you at 75 MPH.

Does this help my case? I have a one-year old son that I take to daycare before I go to school. I have the sign-in sheet from that day for 7:50 am and I was pulled over at 8:25 am. I left straight from the daycare. The distance between the two places is approximately 17 miles. Any advice would be great.

That's not very helpful. You could have stopped for a latte & then taken off at 75. Read up on how radar works & see if you can figure out a way to show that the reading was inaccurate.

in refrence to you calling me crazy


I left you a long message to read in the new post under my name toyia.It was left at 11:51am about my dad killing my mother.For everyone else reading this i invite you to read and give me your oppinion on whether or not i should forgive him and help him get out after he was promised a realase date but the chairman went back on it.He even told him he would not be eligible for three years.

This post is over a YEAR old!!! And your comments have nothing to do with this thread. Stealth also responded to it. There is nothing you can do about your situation. Write a letter if you are so compelled, but the parole board determines when and if he is eligible. Promises mean nothing.
