Speeding over 30 in FL


Florida

I recently received a ticket for going 70 in a 40. The police officer told me that all I needed to do was traffic school or pay the fine. I had already gotten a ticket early that year and did traffic school so I elected to pay the fine.

Well, about two months later I received a letter in the mail with a check for the fine amount I paid as well as a note saying it was being refunded because of a mandatory court appearance.

I was never notified that I needed to go to court or given a court date.

I imagine I need to call the clerks office to find out when my court date is. My other question is, what could happen at this court appearance? Will I just be fined or could my license also be suspended?

You probally will pay a hefty fine but the chances of you losing your license I say are marginal. Best bet though is to hire a lawyer.

So now you have 7 point (or soon will have) on your driving record. and the officer may not have known about your previous infraction. Still, an automatic suspension does not kick in until I believe 12 points in the previous 12 months.

That does not say that the judge can suspend you for other reasons...one being you haven't learned a thing by traffic school

Thanks for the help guys.

Yes, I now currently have 7 points on my license if you include this one. What kind of fine can I expect to pay? Are than any other thoughts or suggestions?

I spoke with someone at the clerks office today and she told me that this court date would not result in me getting my license suspended. She said it was only a matter of the amount of the fine.

I don't quite believe this. It seems extremely illogical that they would go through all this trouble only to fine me for a little more money. Is it possible that she could be wrong?

Call the florida bar association and ask them for a traffic lawyer recommendation for your town.

try the national motorists association refferal service as well...

Spend a morning in traffic court and see which lawyers are doing a lot fo busness and getting the best results.

I also got a speeding ticket in Florida for 30 over the speed limit and it is a mandatory court appearance

this is good news for me (if its ture) that the only reason you go to court is to find out how much your fine will be i just want to be able to take traffic school so i do not get points

court date is march 20 2007
