ticketed in ****** county for doing 86mph. had the cruise control set for 73mph. speed limit is 70mph. officer verbally told us he based our rate of speed on the fact he clocked another car passing us at 89mph but he put on the ticket he used a radar gun on us. the speedometer has been checked on car and is accurate. is there any way we can request proof our car was actually clocked by his radar? feel like we should fight this somehow. told officer we had cruise control set at 73 and he didn't believe us. wanted to know if we wanted to argue about it.
only have 30 days - please help!!!! |

| | | | When he's testifying in court ask him if he specifically clocked your vehicle. If he says "no" then that should create plenty of doubt in the judges mind (unless the judge is an idiot). Do you have any witnesses that heard him tell you that he clocked a different vehicle? If so, bring them to court with you!
FINALLY, YOU SHOULDN'T HAVE ADMITTED THAT YOU HAD YOUR CRUISE CONTROL SET TO 73 IF YOU WERE IN A 70 ZONE! Hopefully the officer didn't make a note of that and won't remember that you said it. |

It's tough work. You know, as much thought as they put into smuggling drugs, if they put that much into doing something useful for society, just think what they could accomplish!

First of all, the radar is secondary to sight. An officer makes visual acknowledgement that you appear to be speeding and he could do that in different ways. One of them is to pace you, or by watching the speed with which you are catching up to and/or overcoming other vehicles. The radar only backs him up. And there is no "proof" in the way of a print out or some other paper.
Everybody is screaming about radar. What do you think they relied on before radar? |

It's being handled. We have his ISP numbers, and information is now going to them, with a request that the owner of the numbers take appropriate action.
