Speeding Ticket


What is the name of your state?

Washington State


I recently received a speeding ticket. The officer was parked several miles in front of me on US Route 195 facing the direction i was going. As i approached him he turned on his lights and signaled me to pull over. I did and he told me that they were patrolling the highway with an aircraft and I was clocked using landmarks and a mathematical formula twice at 68 and 73 MPH in a 60 MPH zone. I told him my cruz-control was broke and i was having trouble maintaining a speed. He proceeded to issue a ticket for 13 MPH over the posted limit. There were no signs on the highway stating that the road is patrolled by aircraft. Does there have to be postings of this type of patrolling and should i contest this ticket?

Also, I asked if a warning would be more appropriate since my record has been clean for the past 5 years and he replied by saying not in winter weather conditions and going 13 MPH over the limit. But the sun was out, the roads were dry, and the traffic was moving between 60 and 70 MPH so i was following. So i didn't feel the weather played a factor.

You give no indications the citatation was not legal or valid. No signs are required that aircraft are patrolling. I would suggest talking to a local attorney for other options available to you if you wish to contest the ticket.

One issue that worked in Arizona (I beleive) was that the cited driver was able to get the ticket dismissed on a finding that the citing officer did not witness the violation and had issued the citation on 'hearsay' evidence from the officer in the aircraft.
Depending on the specific factors, you might consider that defense.

JETX is correct in that usually both officers would have to be present in court. One to testify that it was your vehicle and the other to testify that you were the driver.

Unfortunately in Washington State the officer is not required to appear for you to be found guilty. His written statement is read in court. Washington also does not allow traffic school.

If you wish to contest the ticket then follow racer72's advice.
