Speeding ticket #2


Son got a speeding ticket in Jan, Paid fine got 90 days probation,which ends April 12th. At that time he has to sign affidavit certifying that he has not received any convictions for moving violations. Well he got stopped again speeding. The new tickets says he has to appear by March 18th, if he uses the grace period of 30 days that will put the court appearance and conviction after April 12th. Can he legally do this ??

Probationary period


I am not a lawyer and im not sure of the state you live in. I can tell you that I am in Law Enforcement.

Now most generally during a probation period on a traiffic infraction, they are going to base the violation on the day of the infraction. In other words court days signings and other paper work are not going to come into play. If a person is given a time line of probation, say from march 1st to June 1st, then the person on probation had usaually better not be cited into court during those dates or should I say clearly the person should not have been violating any traffic laws during the probationary period.

keep in mind that I don't know the laws in your sate however thats the way it works in oregon arizona and washington.

For what ever it is worth, you may want to have your son if he has not already done so, go to a traffic safety class, before he developes a pattern. good luck.
