speeding ticketALABAMA I was clocked at going 13 miles over the speed limit. However, I do not think that it was my car that the officer clocked going at that speed. The officer was in the lane to the right of me and in front of me. There were at least 4 other cars behind the officer in both lanes. The cop pulled me over for speeding. i was going 83 in a 70. After he handed me the ticket, I asked to see the radar where he clocked me speeding. He responded with when you get detected for speeding from behind his vehicle, it does not lock in, so he could not show me. I asked him then how does he know it was my car that was speeding, and he said "take it up with the judge". Should I try to fight this speeding ticket, considering there were other cars behind him, and it did not lock-in? And if I can fight this, then do you have any suggestions for what I should say in court to the judge? thank you. Last edited by lam1002; 08-19-2007 at 07:16 PM. |

Radar can give false readings1. You were cited for 83 in a 70. When you sign the ticket that isn't an admission of guilt. It only means you promise to appear in court if you contest the charge. 2. The officer did say to take it up with the judge, didn't he? You would follow his instructions wouldn't you? 3. Radar can be inaccurate for the reason you stated and more. In Beat Your Ticket Go to Court & Win by Attorney David W. Brown six pages explain radar and what can make a radar reading inaccurate. This book covers every aspect of a traffic ticket from being cited to appeal. I think this book is essential if you decide to fight your ticket. It's available on Amazon.com for $14.95 or free from the library if they have one on hand or can request one for you thru a different library. 4. Check if Alabama has discovery. This means you're entitled to the officer's notes, radar records , etc. before trial upon a written request by you to the officer and the D.A. If not available in your state you can file a request for Public Records pertaining to your case. Send Certified Mail, Return Receipt if mailed. Regards, Hey There |
