Speeding ticketFlorida-Palm Beach Cnty-Palm Beach Lakes Blvd., West Palm Beach Conditions were over-cast. Not a bright sunny day. This is what happened. Driving on this street which is 3 lanes was in the fartest right hand lane(not the passing lanes) going east. Stopped at a traffic light when light turned green moved with rest of traffic. Was not first car in the pack. It was 11:18am on a friday and this street has a large shopping mall on it which I had just passed. I passed signs that said 30mph I looked down and was going 34mph. I went about 1/4 block on this street(there are houses now with a service road to get to these houses), when suddenly an officer appeared physically in the road in my lane and signaled for me to pull over. Before this turn in to this service road which is like turning into a drive-way right off of this busy street there were 2 company vans similar to a telephone companies vans which the officers had parked their vehicle in front of and the officers motorcycle. One officer was standing behind a palm tree which was perhaps a foot or so from the curb and he was hanging behind this shooting the radar into traffic. Now, If I had been going 51mph I would not have been able to turn into this service road and I would have probably knocked over this officer. Plus, where they had us turn into was dangerous as you had to back out and then turn onto the highway and you couldnt see the oncoming traffic as the vans and their vehicle was blocking the vision to do so..I thought that it was dangerous. Anway, I took the ticket and drove off but, I came back that way in the opposite direction and an hour later they were still there. The cop with the radar scanned the cars and had to wait until the officer writing the ticket was done and then he would get the other officer to get another car to pull over. They were writing these tickets pretty quickly and I wonder in a pack of cars how the officer with the radar knew which car was speeding by observation as the other officer was either busy and not always watching the cars with him. Being behind that tree and shooting at 3 lanes in a pack of cars I dont see how he could have gotten an accurate reading and whose car it was. Here are some questions: If a traffic violation has been issued and the citation says that the speed limit is 40mph and the officer says that the radar gun says the car was traveling 51mph or 11 miles over the limit but, the signs posted say the speed limit was 30mph. Is this a basis for dismissal since the officers didn't know whether the limit was 40mph or the signs posted? Apparently the county posts the signs but, the city police can patrol this street and ticket vehicles. Also, does it matter that while one officer was handling the radar gun the other was writing the ticket and when the other one wasn't available that cars were let to just drive by that were speeding? Does it matter that the street was 3 lanes and sometimes only the cars in the fartest right-hand lane which is the slowest lane were the only cars that were pulled over due to convenience of the officers? Is it considered to be an illegal speed trap as they were hiding behind a palm tree and also 2 work company trucks from another company that blocked the view of their cop car and motorcycle? How did the officer know what car he observed? How does the radar gun keep track of whose car is whose? Shoud they have been calibrating this gun after every shot of that gun as they were scanning alot of cars quickly? Whatt about this officer standing in the middle of the lane and having cars move into this blocked view street? Can you see anything that I can use here as I truely was not speeding and feel as if I was a victim of a end of month quota. I have no other tickets, points assessed, etc, and have a good driving record and have been driving for 32 years. Thank you..sorry but, I couldnt be brief. |
