Question

speeding ticket in NY state

What is the name of your state? Registered driver in NJ

I was visiting friend in upstate NY yesterday and got pulled over for speeding. The officer stated I was doing 74mph in a 35mph zone, but when he pulled me over I was 2 miles away from that zone (and in a 55mph zone). I was actually stopped in traffic and he came on the shoulder, saw my car in line, and asked me to pull of the road.
My questions are:
1. Should I go to court in the small town of Tuxedo, known for speed traps to locals and fight the ticket based on the proof the officer has that he clocked me in the zone he claims with the speed he says? I did not see his car there, he did not follow me with lights on through traffic, just seen me sitting in the line of cars and having out-of-state plates and a sporty car and eventually remembered that I was going faster than the limit and gave me a ticket.
2. What do I risk going to court in NY state while being from NJ? What deal can I expect to obtain in the best case, if I decide to go?
Thank you for your time and advise.

Only if you want a home-cooked meal. Tuxedo is notorious for three things: 1, using the mismarked section of 210 (a 35 mph section of an otherwise 55 mph highway) 2, hiding in the bushes and private lots 3, if 1 & 2 don’t work, they use “random stops.” Sounds like what you encountered.

Call Casey Raskob at 914/271-5383. He’s a traffic law attorney in Croton-on-Hudson, even the same county as Tuxedo (Orange County, NY).
