Speeding Ticket on Sunday - North Carolina


What is the name of your state? North Carolina

Hi,

I got a speeding ticket in 45 mph Zone and officer told me that I was driving 58 mph (road Chappel Hill - NC 54 )-Wake County.But I was not convinced about the speeding.When I immediately checked the speed limit I am already in 55 MPH speed Zone.

1.When I received a ticket from the officer,We are already in different county (Durham).
2.I did not not have any interest to drive fast on Sunday when nobody was around me.I was hungry and driving for food.

I am travelling around this country a lot and have excellent driving record ( just before this ticket)

Do I need to dispute this in the court ?.Is there any chance of being not guilty in this case.Please advice.

1. You watched the Dukes of Hazzard too many times. Crossing a county line does not mean you are home free.

2. So. Sounds like a good excuse to speed.

Nothing in your post suggests the officer did anything that warrants the citation being dismissed, I would suggest talking to a local attorney if you want to fight the ticket.

Thanks for your reply.

Citation option is checked as

You do not have to appear in District Court.Shows $ 25 (Fine) + $100 (Court fee) = $125

Do I need to dispute on this case ?

You should. In NC 10 mph or more means your insurance goes up for the next three years. Weirdly enough 9mph over and the insurance can't raise it for the speed violation.

In the court they often give you a chance to plead guilty to less than 10mph over the limit. It makes a big difference.

Was it a state trooper that gave you the ticket?

Does your county offer a defensive driving class, usually taken at a community college on a Sat? If so take it, and it will not show up on your license or insurance.

There are 16 Judicial Districts In 42 North Carolina counties that allow traffic violators to complete a National Safety Council Defensive Driving Course in exchange for a reduction in penalty. The rules and procedures for completion vary with each county.

Wrong day specified in the Ticket


Thank you for your response.

I came across one more find in my ticket.The day of the week wrongly specified.The court date is 10/27/05 but day of the week as Friday which is not correct.(27th Oct falls on Thursday NOT Friday.)

Do I have any advantage on this if I dispute the case. ?

Errors on the ticket usually do not matter since the ticket can be corrected.

My first traffic ticket


This is my entire story

I am a good defensive driver having excellent driving record before
this ticket.It was on Sunday afternoon,I was travelling in NC 55
towards RTP,NC.This is my daily commute to my workplace.There are
two singals from my home.1.Airport Blvd 2.Aviation PKWY.
After aviation PKWAY, less than a mile 45 MPH Zone then 55 MPH Zone starts.55 MPH Zone starts on up hill.So,I was very much aware that I am approching 55 mph zone and accelarating my car to maintain the speedlimit.The road was empty and nobody was driving ahead of me.(1-2 mile) .If I was not accelarating I would have hit by other cars behind me.

Yes.I was stopped by the officer right at this point and told me I was speeding at 58 mph(Just before 55 MPH zone).

This is my first ticket in my driving history.

I still can't believe it, I received the trafic ticket for speeding.

Looking for your opion on this case.My court date is Oct'27.

Is there any chance of wining this case ?

I'll try again.

Go to court. If you talk to the District Attorney there's a good chance he will let you plead guilty to nine miles over the limit..

You pay the fine, but the points do not count toward your insurance.

A family member got one for 68 in a 55. He told his story, and was found guilty for nine over the limit. He paid the fine and court costs.

Insurance was raised. I called agent. He got back to me and apologized, Wouldn't say why it was raised. Said it was a mistake and it was reduced to before.
So . I suspect you should go to court. neat, clean, polite etc.

I am not an attorney, nor an expert. What I've writen is my opinion because I am old and read a lot.
