Speeding Ticket using Radar Gun


What is the name of your state?California
I was wondering if anyone in California got a ticket dismissed because the officer did not have the radar gun on showing the speed you were driving at to get the ticket. I was stopped and told I was doing 45 in a 25. The officer then asked for my registration, etc. He then went to the side of his vehicle away from the traffic and proceeded to write my ticket. When he completed this, he walked to my car and handed me the citation. I then told him I thought about this and didn't think I was going 45, could he let me see the radar gun showing my speed. He told me he reset it and it no longer had my speed. How could he have reset it when he never re-entered his vehicle after stopping me? Anyway, I never did see the radar gun. He asked me what speed I thought I was doing and I told him and then said if he clocked me at a higher speed, I wanted to see it. He told me the state of California does not reguire him to show me the speed. Is that true?

A radar gun is just one piece of evidence; he will also testify that as an expert witness you were going x mph in a y mph zone. You have no right to see a radar gun.

There are a lot of good defenses you can put up to a radar citation. For example, the officer can't testify as an "expert witness" if you have shown that the city did not conduct a survey that is required, or did it incorrectly. To read about the defenses, go to your public library, see the librarian who will give you the best book about it. Every library in CA has a copy...
